One of our clients posted a sign in their hair salon warning customers not to sit on the styling stools as they could be unstable. Unfortunately, even with the visible warning sign, one of their clients sat on one of the stools and subsequently fell off, injuring themselves during the fall.
A month after the incident the salon owner was served with a lawsuit. Fortunately, the salon owner had general liability insurance as part of their PROtique plan which meant the insurance company paid for a lawyer to defend the salon owner, and paid the $15,000 settlement to the injury victim.
Example A:
One of our esthetician clients, with 15 years’ experience, noticed shortly after starting a waxing procedure that the area was too tender to continue, and advised their client they were going to discontinue the treatment. The client was insistent that they wanted to continue with the waxing. Because the esthetician didn’t want to upset their client they continued, and the bikini wax was completed as per the client’s specifications.
Unfortunately, the waxing client returned the next day explaining that they had been to the hospital to receive stitches as they had experienced bleeding after the waxing procedure. The client had retained a lawyer who alleged professional negligence.
Fortunately, our esthetician client was covered by professional liability insurance, their PROtique insurance policy paid out almost $14,000 in settlement fees two years after the incident.
Example B:
Another example is where one of our clients had a new customer wanting her eyebrows and upper lips waxed. The customer had advised that she had very sensitive skin.
The experienced esthetician used a very pliable warm wax due to her client’s sensitive skin. However, the client asked for the wax to be at a higher temperature as they didn’t think the cooler wax would be effective.
The esthetician completed the service to the client’s specifications. The next day however, the client called to report she had been burned by the wax and was seeking compensation.
Fortunately, our client has professional liability insurance coverage through the PROtique Masterplan policy, which means she has peace of mind that this situation is being handled through the insurance company.
Example A:
A salon owner unfortunately experienced a property fire, which caused extensive damage, due to a candle that had been left burning after the spa had closed for the day. Because of the widespread fire damage, the spa was closed for a few months, this had a big impact on our client as the spa was their only source of income.
Through the PROtique policy the insurance company advanced funds immediately to the client, and eventually the whole claim was settled for just over $500,000, which covered lost profits, paid for ongoing expenses while the spa was closed, and paid to replace the lost contents, renovations and leasehold improvements.
Example B:
One of our salon owner clients had the unfortunate situation where a fire started in a neighbouring unit and spread to their property causing considerable damage.
Through the PROtique Masterplan insurance policy our client received funds to cover lost profits and to pay necessary ongoing expenses while the salon was closed due to the fire damage.
Unfortunately for our client, they had not increased their contents limit to account for the replacement cost of all furnishings, equipment, and stock, or the renovations and leasehold improvements she was responsible for in her leased unit. As a result, her insurance only covered a fraction of the actual loss. We were successful though in getting her a bigger settlement after we discovered an error in the original settlement offer.
One of our esthetician clients purchased a new bed for their treatment room. Unfortunately the new bed collapsed while a client was receiving treatment. Due to the injuries received during the fall, the client went for physiotherapy to assist with the healing process.
A few weeks after the incident the esthetician received a notice from their client’s lawyer indicating their intent to sue as a result of the injury.
Fortunately for our esthetician client, their PROtique insurance policy included legal assistance and the insurance company lawyers handled the situation. It took two years to negotiate the settlement of $30,000 which was paid by the insurance company.
One of our clients had the unfortunate incident of a water main breaking outside their salon, resulting in the loss of water supply to their property for three days. The salon closure resulted in a loss of income during this time.
The insurance company for PROtique paid over $12,000 to our client for lost profit and to reimburse necessary expenses such as salaries for the staff during the closure, rent and utilities.
An intense storm caused extensive water damage in our client’s hair salon, closing it down for several weeks until the flooring and drywall could be replaced.
To compensate our client for the lost revenue and expenses incurred to repair the salon, a total payout of $28,000 was made by the insurance company for PROtique. This helped our client retain key employees because they could continue to pay their salaries until the salon re-opened.
One of our spa owner clients was presented with a $250,000 negligence lawsuit. One of their clients who had received laser hair removal treatment experienced a burning sensation and numerous red, raised burn marks on the treated areas. The lawsuit indicated she had scarring that may require corrective treatment, and reported the client was suffering from insomnia, anxiety and depression.
Fortunately the salon owner had Professional Liability Insurance through their PROtique plan, the insurance company paid for the $27,000 settlement to the victim and for the client’s lawyers.
A salon client approached the door to go in for an appointment just as another customer was exiting the salon. The door opened and unfortunately hit the woman trying to enter, which resulted in her falling to the ground and sustaining serious injuries including a broken hip, neck and back pain.
A month later our client was presented with a lawsuit for over $500,000 alleging they had not taken reasonable care to prevent a dangerous situation, had not warned people of the dangers of walking by the door, and that the door was a danger to people using it.
The PROtique Masterplan policy, which includes general liability insurance, paid to defend the salon owner, and paid the $125,000 to settle the claim with the victim.
A break and enter occurred in our client’s home-based spa. During the break-in, the thieves stole her laser hair removal equipment.
Fortunately our client’s PROtique Masterplan policy quickly got her business up and running again, they paid $16,000 for the new replacement equipment that needed to be purchased.
One of our clients owned a spa with a single step up leading from the reception area towards the treatment rooms. Unfortunately, even though the step was clearly marked, within the space of three months, two clients had tripped and fallen on the step. In both incidences the clients refused help at the time of the fall, however a few months later our client received notice from both of their lawyers notifying them that lawsuits were being filed.
Both of these claims were settled through the PROtique Masterplan insurance policy which includes up to $2,000,000 of general liability coverage to give salon owner clients peace of mind in situations such as these.
